What are the penalties for businesses engage in brokerage or re-sale activities without obtaining the necessary qualifications?

To establish orders of real estate transactions and to protect interests of buyers and sellers, the County Land Administration Office has been strengthening the enforcement against illegal brokers (brokers that engaged in the business without filing status as brokers). Any persons who wished to engage in the business should apply accordingly as regulated under The Real Estate Broking Management Act and related provisions, to prevent penalties.

Lands Department said, according to the provisions of Article 32 of The Real Estate Broking Management Act:( a) the business will be seized and the principal, business owner, or the actioner to be fined for no less than 100,000 NTD and more no than 300,000 NTD. (b) Those who continued to operate after the seize of business, will serve one year of imprisonment, detention or fined for no less than 100,000 NTD and no more than 300,000 NTD.
