One day off should be given to labors with voting rights on the Election Day

The County Labor Department said a PTO should be given to voters based on the interpreted Enforcement Rules of the Labor Standards Act Article 23 of “Presidential Election/Veto Day”, under Council of Labor Affairs, Executive Yuan’s (Ministry of Labor) Labor Act No.0970130105 from 25 February 1997. Under the article, the PTO should be given to voters who are scheduled for work on the Election Day, and does not apply to those who are not scheduled for work. The term “PTO” refers to 12am of the Election Day until 12pm on the same day. Should the employer acquire permission from the labor to work on that day, wages should be paid based on the additional working hours, while no interference of labor’s act of voting.

The Labor Department also points out that the employer is subject to not only a fine of NTD 20,000 to NTD 300,000 but also whose company name, owner’s name will be disclosed by the administrating authority in the case of violation of the article.
